Your last working day has passed and the relieving letter has not come, with the new joining date getting close. HR says it is in process, or says nothing, or wants money you do not think you owe first.
If you have not resigned yet, start with leaving a job in India. For what a correct relieving letter should say, the relieving letter format page goes through it line by line.
Find out why the letter is being held
Get the reason in writing before you push. It is usually one of these:
- A paperwork delay. The settlement is waiting on finance, or HR issues letters in a monthly batch.
- A notice shortfall. You left before the notice period ran out, and the company wants the difference.
- A bond. Your appointment letter or a separate agreement says you owe money for leaving early.
- Property or clearance. A laptop or ID card is recorded as unreturned, or nobody has signed off your handover.
- A pending disciplinary matter, or a resignation that was never formally accepted.
The first is the most common, and a polite written nudge usually fixes it. The rest are disputes, and each needs a different reply.
What Indian law does and does not require
No central law requires an employer to issue a document called a relieving letter. New employers ask for it, so old employers issue it, and no section sets a deadline for it. An employer that withholds it for no reason is still on weak ground. In 2013 a Delhi district court ordered a software company to issue one, along with three months of unpaid salary, to an employee who had met the terms of his appointment letter.
Three pieces of law come closer.
A service certificate, if you count as a "worker"
Standing orders, the service rules that larger industrial establishments must have, have long entitled a workman to a service certificate stating his designation and period of employment when he resigns. The model standing orders in the Central Rules, 1946 say so directly. Standing orders now sit under the Industrial Relations Code, 2020, which applies them to establishments with 300 or more workers (section 28). Section 2(zr) of that Code also leaves out anyone employed mainly in a managerial or administrative capacity, and supervisors earning more than ₹18,000 a month.
Your wages, within two working days
The Code on Wages, 2019 has been in force since 21 November 2025. Section 17(2) says that when an employee resigns, the wages payable must be paid within two working days of the resignation. The Labour Ministry's compliance handbook for employers states the rule the same way. It covers managers too, because the Code's definition of employee includes managerial and administrative work.
Two caveats. "Wages" has a defined meaning, so gratuity and PF follow their own timelines, and whether leave encashment counts is open to argument. A state government can also set a different time limit under section 17(3). Many companies have not yet moved off 30 to 45 day settlement cycles.
Bonds can be enforced
In Vijaya Bank v. Prashant B. Narnaware (May 2025), the Supreme Court upheld a clause that required a bank manager to serve three years or pay ₹2 lakh, holding that it was not a restraint of trade. In May 2026 the Bombay High Court, in Bharat Aviation v. Rahul Sudhindra Soni, held that an employer justified in refusing a resignation that broke a training bond "cannot be forced to issue a relieving letter or experience certificate". The court noted that this was not a case of an employer refusing without good reason. If a bond is the reason, settle the bond question first, because the letter depends on it.
Escalate in writing, in three steps
Keep each message short and factual, and send it from your personal email, since your work account will be closed. Leave about a week between steps, or less if your joining date is close.
Step 1: the request
Subject: Relieving letter and full and final settlement, [Name], [Employee ID]
My last working day was [date]. My resignation of [date] was accepted by [manager] on [date], and my handover and asset return were completed on [date].
Please send my relieving letter, experience letter and full and final settlement statement by [date]. If anything is pending from my side, please tell me what it is so I can close it.
Step 2: ask for the reason in writing
Send this to the HR head and copy your former manager.
I have not received my relieving letter or settlement since my last working day on [date] (earlier email below). If the company believes something is outstanding, such as a notice shortfall, a bond amount or company property, please state the item and amount in writing so I can respond. Under section 17(2) of the Code on Wages, 2019, wages due on resignation are payable within two working days. I would appreciate the documents by [date].
Step 3: the final letter
Send it by email and by Speed Post to the company's registered office, and keep the postal receipt and the tracking printout.
This is my third request for my relieving letter, experience letter and full and final settlement. My earlier requests of [date] and [date] are enclosed. No reason for withholding them has been given. If I do not receive them by [date], I will pursue the remedies available to me, including a claim for unpaid wages under the Code on Wages, 2019.
Most delays end at the first or second step. If yours does not, this thread is the evidence every later step relies on.
Keep your new offer alive
Tell the new employer's HR before their background check finds the gap. Say the letter is awaited, give the reason if you know it, and offer documents that prove the same facts:
- your resignation email and the email accepting it
- the last three payslips, with a bank statement showing those salaries credited
- your EPF service history from the EPFO member portal, which records the joining and exit dates for each employer
- Form 16 for the last full year (Form 130 from the 2026-27 tax year), or Form 26AS or the Annual Information Statement, which list tax deducted by each employer and come from the Income Tax Department, not your employer
- your appointment letter, and the email thread from the steps above
Many HR teams will also take a signed self-declaration of the facts: your last working day, the date your resignation was accepted, and the dates you asked for the letter. The self-declaration format page shows how one is worded, and you can fill one in on the letter maker. Declare only what is true, because it is a signed statement and the new employer will check it.
Ask the new HR to confirm in writing that they will accept these for now, and whether their verification agency will contact your old employer directly.
When the hold is about money
For a notice shortfall, ask for the calculation: the number of days, whether it is on basic or gross pay, and the clause it relies on. Check it against your appointment letter. If your manager agreed to an early release, get that in writing before you argue about the amount.
Section 18 of the Code on Wages lists the only deductions an employer may make from wages, and recovering unserved notice is not one of them. Whether that stops the usual practice of adjusting notice pay against the settlement is not settled, so raise it as an argument without counting on it.
If the amount is small next to what a lost offer would cost you, it is often more practical to pay it and say in the same email that you dispute it. Ask for the relieving letter to state that the shortfall was adjusted, a standard variant covered on the relieving letter format page.
For a bond, read what it says: the amount, the period, and whether the amount reduces for time served. In the Bharat Aviation case the court suggested the employee offer a reasonable amount, since he had served about half the bond period. An offer in proportion to the time you served is a fair place to start.
For property, return it against a written acknowledgement, or courier it with proof of delivery and email photographs of what you sent.
When writing does not work
For unpaid wages and the settlement, you can file a claim under section 45 of the Code on Wages before the authority the government appoints, usually in the labour department. Claims can be made within three years, and the authority can add compensation of up to ten times the amount due. Authorities are being notified state by state, so check your state labour department's site for yours.
For PF, you do not need the old employer. For Aadhaar-verified UANs, employer attestation of transfer claims has been dropped. If your old employer has not marked your exit, the member portal lets you mark it yourself once two months have passed since the last contribution. Anything else goes to EPFO's grievance portal, EPFiGMS.
For the relieving letter itself, see a lawyer, because the route depends on your contract. A legal notice is the usual first step. A civil suit for a mandatory injunction is what worked in the Delhi case above. Where the appointment letter had an arbitration clause, an employee got an interim order from the Bombay High Court directing the employer to issue his relieving letter and Form 16, as this 2025 judgment records. A writ petition against a private company is generally not maintainable, and the Karnataka High Court dismissed one on that ground in December 2025.
What not to do
Do not make your own relieving letter or edit an old one. Making a false document is forgery under section 336 of the Bharatiya Nyaya Sanhita, 2023, and section 340 punishes using one as genuine in the same way as forging it. Verification agencies confirm letters with the issuing HR team, and a forged one can cost you the new job years after you join.
Do not sign a settlement form or a "no claims" declaration without reading it in full, just to get the letter released. And keep the new employer's HR updated as things move, so their verification agency does not find the gap first.
Free, no account, and the fixes are listed in plain words rather than as a number.
Frequently asked
- Can a company legally withhold a relieving letter in India?
- No central law sets a deadline for a relieving letter, so it turns on the reason. A Delhi court has ordered an employer to issue one where the employee had met the terms of his appointment letter. The Bombay High Court has held that an employer which was justified in refusing a resignation made in breach of a bond could not be forced to issue one. Ask for the reason in writing before you decide what to do.
- Can my company hold the relieving letter until I pay the notice period buyout?
- Many companies do, and how much they can claim depends on the notice clause in your appointment letter. Ask for the calculation in writing and check it against that clause. If you pay, ask for the relieving letter to state that the shortfall was adjusted. If the figure is wrong, dispute it in writing and keep the thread.
- How soon must the full and final settlement be paid after I resign?
- Section 17(2) of the Code on Wages, 2019, in force since 21 November 2025, says wages due to an employee who resigns must be paid within two working days. Gratuity and PF follow their own timelines, and a state government can set a different limit for wages. Many companies have not yet changed their 30 to 45 day settlement cycles.
- Can I join a new company without a relieving letter?
- Often, if the new employer agrees. Offer the email accepting your resignation, your last payslips, your EPF service history and Form 16, with a signed self-declaration of the facts, and ask HR to confirm in writing that these will do while the letter is chased.
- Can I complain to the labour commissioner about a relieving letter?
- For unpaid wages and the settlement, yes. Any employee, managers included, can file a claim before the authority appointed under the Code on Wages. For the letter itself, the labour office's role is clearer if you are a worker under the Industrial Relations Code. Managers usually need a lawyer's notice and then a civil suit or arbitration.
